This Acceptable Use Policy ("AUP") is part of your Agreement with Moonage, Inc. ("Moonage") and applies whenever you use the Services. Capitalized terms used but not defined in this AUP have the meaning given in the Terms of Service. Moonage may update this AUP from time to time in accordance with the Terms of Service.
Your responsibilities
You are responsible for:
- keeping your access credentials (such as your username and password) safe and private, and not sharing them with anyone else;
- notifying Moonage immediately at legal@moonage.ai if you suspect or discover any unauthorized access to, or use of, the Services or any access credentials;
- ensuring that you have all necessary rights, permissions, and consents to use any third-party content, data, calendar information, or meeting recordings included in your Input or connected through a Third-Party Integration;
- evaluating the accuracy and suitability of any Output, including through appropriate human review, and verifying that your use of Output does not violate any third party's rights; and
- ensuring that all of your Authorized Users comply with this AUP and the rest of the Agreement.
Prohibited uses
You agree not to, and not to direct or allow your Authorized Users or any third party to, use the Services to:
- violate applicable laws or the rights of others, including to:
- violate, encourage the violation of, or otherwise compromise the privacy or legal rights of others;
- infringe, misappropriate, or violate the intellectual property rights of a third party;
- identify an individual from biometric data or create a biometric database;
- exploit the vulnerabilities of an individual or group arising from their age, disability, or social or economic situation, in a way likely to cause them harm;
- evaluate or classify individuals based on their social behavior or personal characteristics in a manner that results in detrimental, unfair, or unfavorable treatment (including social scoring or profiling); or
- create, share, or store clearly offensive, abusive, or otherwise inappropriate material;
- compromise the security or integrity of others or of the Services, including to:
- introduce or permit the introduction of any virus, worm, Trojan horse, malware, corrupted file, or other destructive or deceptive item into the Services or Moonage's networks and information systems;
- interfere with the proper working of the Services or the equipment used to provide them; or
- disable, interfere with, or circumvent any aspect of the Services or any measures used to restrict access to them;
- transfer your right to access or use the Services to any third party, or share accounts;
- reverse engineer or attempt to derive the source code of the Services or any portion of them, except as permitted by applicable law;
- modify, customize, port, translate, localize, or create derivative works of the Services;
- use any automated or programmatic method to extract data or Output from the Services — including scraping, web harvesting, or web data extraction — other than methods Moonage provides within the Services;
- use your access to the Services to build a product or service that competes with the Services;
- submit, store, or process any Sensitive Data through the Services, except as expressly agreed in writing with Moonage;
- provide any licensed or regulated services (for example, legal, medical, or financial advice) without review by an appropriately qualified human professional;
- make automated decisions that have a material or detrimental impact on individual rights without meaningful human supervision; or
- make, or act as a substantial factor in making, decisions about an individual's access to education or educational opportunities, employment opportunities, or eligibility for essential services, without meaningful human involvement.
European Union
To the extent any Output is used in the European Union, or if you or any of your Authorized Users are located in the European Union, you further agree that you will not use the Services to:
- make decisions about an individual's enrollment in, access to, or admission to educational opportunities;
- evaluate learning outcomes in education or vocational training;
- assess the appropriate level of education that an individual will receive or be able to access in education or vocational training; or
- research and interpret facts and the law, and apply the law to a concrete set of facts, where you are a judicial authority or acting on behalf of one.
Enforcement
Moonage may investigate suspected violations of this AUP and may suspend or restrict access to the Services in accordance with the Terms of Service. A violation of this AUP is a breach of the Agreement. Nothing in this AUP limits any other rights or remedies available to Moonage.
Processing of personal data
To provide the Services, Moonage processes personal data. You can find out more about how Moonage processes personal data, and your rights in relation to that processing, in Moonage's Privacy Policy. Where Moonage processes personal data contained in Customer Data on your behalf, that processing is governed by the Data Processing Agreement that forms part of the Agreement.
