This Artificial Intelligence Policy (the "AI Policy") sets out the approach of Moonage, Inc. ("Moonage") to the development and deployment of artificial intelligence ("AI") in connection with the Services. It is intended to provide transparency about Moonage's practices and principles relating to the use of AI, including compliance with applicable laws, responsible use, data handling, technical and organizational measures, transparency, and risk management.
This AI Policy is incorporated into and forms part of Moonage's Terms of Service and Privacy Policy and should be read alongside Moonage's Acceptable Use Policy, Security Policy, and Data Processing Agreement. In the event of any conflict between this AI Policy and the Terms of Service or Privacy Policy, this AI Policy prevails with respect to its subject matter. All provisions of the Terms of Service, including those relating to changes to the Services and termination, apply equally to the AI Features unless expressly stated otherwise here. Moonage may update this AI Policy from time to time to reflect changes in technology, regulation, or industry best practice.
1. Definitions
1.1 AI Features means any artificial-intelligence or machine-learning capabilities provided as part of the Services, including the Moonage AI agent and meeting, calendar, summarization, and drafting features.
1.2 Input means any data, content, or instructions provided by you or your Authorized Users to the AI Features.
1.3 Output means any result, suggestion, or content generated by the AI Features based on the Input.
1.4 Beta AI Features means any AI Features released in a beta, preview, early-access, or similar pre-release state.
Other capitalized terms have the meaning given in the Terms of Service or the Data Processing Agreement.
2. Compliance with laws
To the extent applicable to its provision of the Services, Moonage will comply with applicable laws, regulations, and directives relating to the provision of AI, including the European Union's Artificial Intelligence Act (Regulation (EU) 2024/1689) and other applicable AI regulations. Moonage monitors developments in AI-related regulation and will work with you in good faith to address regulatory requirements as they become applicable to the AI Features.
3. AI literacy and responsible use
Moonage takes steps to ensure a sufficient level of AI literacy among the employees who operate and use the AI Features, consistent with applicable AI regulations, and has implemented and will maintain internal policies and procedures for the ethical and responsible use of AI.
4. Model providers and data sources
4.1 Model providers. The AI Features are powered in part by third-party AI model providers, currently including Anthropic (Claude). These models support features such as summarization, reasoning over user-provided context, and drafting user-directed content and actions. Moonage uses commercially reasonable efforts to diligence its model providers, but does not control the training or hosting of third-party models; the Terms of Service govern Moonage's and the providers' respective responsibilities for Third-Party Models.
4.2 Data sources. Where Moonage incorporates data sets into the Services, it takes steps to obtain the necessary rights or licenses and to monitor and verify compliance with third-party rights in collecting such data.
4.3 No sharing with external AI companies for their own purposes. Moonage does not share your Customer Data with external AI companies for their own purposes. Your inputs and outputs are processed by model providers only to generate Output for you and are not made available to those providers to train their models. Providers may receive non-content technical metadata (such as API call metrics), but not your actual Input or Output beyond what is needed to return the Output.
5. Data usage and handling for AI Features
5.1 Handling. Moonage handles data related to the AI Features in accordance with its Privacy Policy, Security Policy, and Data Processing Agreement. AI-related Input and Output are treated the same as any other Customer Data and follow the same security, retention, and deletion procedures.
5.2 Purposes. By using the AI Features, you agree that Moonage may process your Input to (i) provide the AI Features to you and (ii) improve the quality and performance of the AI Features by analyzing technical aspects such as usage patterns, prompt types, errors, and suboptimal behavior. Any Input analyzed for improvement is anonymized so that it is not traceable to individual users, and the analysis focuses on technical performance and functionality rather than substantive review of the confidential or proprietary content of the Input.
5.3 No training on your data. For the purposes of this AI Policy, "train" or "training" means using your Input to adjust, fine-tune, or otherwise modify the weights, parameters, or functionality of any AI model. Moonage does not use your Input or other Customer Data to train AI models, nor do its AI subprocessors use your Input for training. Moonage does not use Google Workspace user data to develop, improve, or train non-personalized or generalized AI or machine-learning models, and does not combine such data with data from other customers for model training. A current list of subprocessors, including those involved in the AI Features, is maintained as described in the Data Processing Agreement.
5.4 Hosting and cross-region processing. AI-related data is stored and processed using Moonage's Cloud Environment as described in the Security Policy, with Personal Data stored within the EU/EEA by default. Because certain AI models have regional availability limitations, the AI Features may involve cross-region processing. Moonage seeks to keep data within its designated hosting region; any cross-border transfer of Personal Data is conducted under the Data Processing Agreement using appropriate safeguards such as the Standard Contractual Clauses or the EU-US Data Privacy Framework where required.
5.5 In-transit and at-rest protection. Data processed cross-region is encrypted in transit and at rest, processed ephemerally for the purpose of generating Output, and is not permanently stored outside your designated hosting region.
5.6 Google Workspace data. Where you connect Google Workspace services, Moonage processes user-authorized data through the AI Features only to provide the product features you request. Moonage's use and transfer of raw or derived data received from Google Workspace APIs adheres to the Google API Services User Data Policy, including the Limited Use requirements.
6. Your responsibilities
6.1 You are solely responsible for the Input you provide to the AI Features and for your use of any Output.
6.2 You agree not to use the AI Features to process or generate content that violates the Terms of Service, the Acceptable Use Policy, or applicable law.
6.3 You should review and validate any Output before relying on it for any purpose, as AI-generated content may be inaccurate or unsuitable for your specific use case. Output is not legal, financial, medical, or other professional advice.
7. Ownership and rights
7.1 You retain all rights to your Input. By using the AI Features, you grant Moonage a limited license to process your Input solely to provide and improve the AI Features as described in Section 5.
7.2 As between the parties, you own the Output generated from your Input. You grant Moonage a limited license to process the Output solely to provide and improve the AI Features as described in Section 5.
8. Disclaimers and limitation of liability
8.1 The AI Features, including any Beta AI Features, are provided "as is" without warranties of any kind, express or implied, except as expressly set out in the Terms of Service.
8.2 Moonage does not guarantee the accuracy, completeness, or appropriateness of any Output for your specific needs, particularly for Beta AI Features.
8.3 Moonage's liability relating to the AI Features, including Beta AI Features, is limited as set out in the Terms of Service.
9. Beta AI Features
9.1 Moonage may offer Beta AI Features for you to test and evaluate. Beta AI Features are strictly opt-in and will not be enabled without your explicit consent, and you will be informed of a feature's beta status before opting in.
9.2 Beta AI Features are provided "as is" and may be incomplete, contain errors, or change significantly before general release. Moonage does not guarantee their quality, reliability, or continued availability, and you should not rely on them for critical operations.
9.3 You may disable or exit a Beta AI Feature at any time, and associated data will be handled in accordance with Section 5. Moonage may modify, suspend, or discontinue any Beta AI Feature at any time and, where reasonably possible, will provide advance notice before doing so.
9.4 When a Beta AI Feature becomes a stable feature, it may transition to opt-out or become a standard part of the Services, potentially subject to additional fees, and you will be notified of such transitions in advance.
10. Technical and organizational measures
Moonage implements and maintains technical and organizational measures for the development and provision of the AI Features, including:
- internal policies governing the use and development of AI;
- the security measures described in Moonage's Security Policy;
- testing to establish, monitor, and verify the accuracy, reliability, and suitability of the AI used in the Services; and
- change-management processes to maintain continuing compliance with applicable laws and industry standards.
11. Transparency and AI governance
11.1 Transparency. Moonage has implemented procedures to help you ensure that the natural persons you choose to have interact with the AI Features are informed that they are interacting with AI.
11.2 Governance support. Moonage uses foundation models for which responsible-AI documentation is publicly available. For Anthropic's Claude models, system cards and related documentation are available at trust.anthropic.com. Moonage will help direct you to relevant documentation from its AI providers — such as model cards and technical information — to support your own compliance assessments and AI governance framework.
